美国贸易代表办公室敲定第二批针对中国产品的关税以回应中国的不公平贸易做法
华盛顿DC – 美国贸易代表办公室(USTR)今天公布了一份清单,将对价值约160亿美元来自中国的进口产品额外征收25%的关税。这是美国对中国在强制美国技术和知识产权转让相关方面的不公平贸易做法的回应之一。在本次据301条款征收第二批额外关税之前,第一批对价值约340亿美元来自中国的进口产品征收的关税已于7月6日生效。
这份清单包含6月15日公布的拟议清单上最初284项关税细目中的279项。对拟议清单做出变更前,USTR和301条款机构间委员会已于上月在为期两天的公共听证中征集并收到书面意见和证词。海关与边境保护局将自8月23日起对来自中国的进口产品征收额外关税。
2018年3月,USTR公布了其详尽的301条款调查的结论。调查发现中国与技术转让、知识产权和创新相关的行动、政策和做法不合理、有歧视性,且对美国商业造成负担。
具体来讲,301条款调查显示:
中国利用合资要求、外国投资限制以及行政审查和许可程序来要求或迫使美国公司进行技术转让。
中国剥夺了美国公司在许可及其他技术相关谈判中根据市场来设定条件的能力。
中国控制对美国公司和资产的系统性投资和收购并以不公平的方式为这些做法提供便利,以此造成大规模的技术转让。
中国进行和支持对美国商业计算机网络的网络入侵,以此在未经授权的情况下获得有商业价值的商业信息。
关于160亿美元关税行动的正式公告很快即将在《联邦公报》上发布。如同第一批额外关税,公告将公布一个流程,有关人员可以通过该流程要求排除额外关税涵盖的某一关税细目下的特定产品。

USTR Finalizes Second Tranche ofTariffs on Chinese Products in Response to China’s Unfair Trade Practices
Washington, DC – TheOffice of the United States Trade Representative (USTR) today released a listof approximately $16 billion worth of imports from China that will be subjectto a 25 percent additional tariff as part of the U.S. response to China’sunfair trade practices related to the forced transfer of American technologyand intellectual property. This second tranche of additional tariffsunder Section 301 follows the first tranche of tariffs on approximately $34billion of imports from China, which went into effect on July 6.
The list contains 279 of the original 284 tarifflines that were on a proposed list announced on June 15. Changes to theproposed list were made after USTR and the interagency Section 301 Committeesought and received written comments and testimony during a two-day public hearing last month. Customs and Border Protection will begin to collect the additional duties onthe Chinese imports on August 23.
In March 2018, USTR released the findings of itsexhaustive Section 301 investigation that found China’s acts, policies andpractices related to technology transfer, intellectual property and innovationare unreasonable and discriminatory and burden U.S. commerce.
Specifically, the Section 301 investigation revealed:
• China uses joint venture requirements, foreign investment restrictions, andadministrative review and licensing processes to require or pressure technologytransfer from U.S. companies.
• China deprives U.S. companies of the ability to set market-based terms inlicensing and other technology-related negotiations.
• China directs and unfairly facilitates the systematic investment in, andacquisition of, U.S. companies and assets to generate large-scale technologytransfer.
• China conducts andsupports cyber intrusions into U.S. commercial computer networks to gainunauthorized access to commercially valuable businessinformation.
A formal notice of the $16 billion tariff actionwill be published shortly in the Federal Register. As in the case of the firsttranche of additional tariffs, the notice will announce a process by whichinterested persons may request the exclusion of particular products covered bya tariff line subject to the additional duties.
