TENANCY AGREEMENT                                    

一、      出租人（以下简称甲方）

      Landlord (hereinafter referred to asparty A)

二、      承租人（以下简称乙方）

三、      租赁范围及用途Tenancy:

4.2  租赁期满，甲方有权收回全部出租房屋，乙方应如期交还。乙

    Upon expiration of the tenancy, Party A hasthe right to take back the entire leased property, and Party B shall deliverthe leased property to Party A on time. Alternatively, Party B have the optionto renew this agreement or quit this agreement upon giving one month priornotice to Party A before the expiration of this agreement.

五、   租金及付款方式 

Rentand the way of payment

5.1  双方谈定的租金为每周       澳元。

     The rent, agreed by both parties, is AUD ______per week.

5.2  乙方支付甲方每月的租金，应    周  支付一次。首次付款日期应在              。

     Party B shall pay        week’s rent in advance, on the last day ofevery four weeks. The first payment shall be made prior to _____________

A：  汇至甲方指定的银行账号(_____________________________________)，支付租金日期以乙方汇出日期为准。

     By transferring the amount or such rent toa bank account designated by Party A and the date of transfer shall be the dateof payment.

B：  以现金方式支付

      Payment in cash

5.3  由于乙方原因未能按期支付租金，乙方须按日加付其月租金0.5﹪的滞纳金。（有3日缓冲期）

     If the rent remain being unpaid on time,Party B shall be liable to pay a late penalty fee equal to 0.5﹪of the month rent per day.（3 days delays）

六、   保证金（押金）：

SecurityDeposit:

6.1  为确保出租房屋及其设施之安全并完好及租赁期内相关费用之如期结算，乙方同意于签订合同当日支付给甲方的租赁押金__     ___________澳元作为乙方确保合同履行之保证金。    

Toensure the welfare and good condition of the leased property and the relatedfacilities as well as the prompt payment and settlement of all related charges duringthe term of tenancy, Party B agrees to pay to Party A within one day after theagreement signed a security deposit  AUD_____in the amount of as security for Party B’s obligations hereunder.

6.2  除合同另有约定外，乙方应于租赁期满之日与甲方点清室内设施，并付清所有应付费用后，甲方当天将保证金全额无息退还乙方。如没有按甲方要求清洁干净或房屋有相应破损，相应修葺金额从乙方押金内扣除。

     Unless other provided in agreement, PartyA shall return to Party B the entire security desposit without interest thereonupon expiration of the tenancy or sooner determination of this agreement afterParty B settled all charges of leased property with Party A. If Party B do not cleanthe room as Party A required or the room or facilities have correspondingdamage. The maintenance cost will be paid by Party B from deposit.

七、   费用担保：

Payment:

7.1   租赁期间物业费和取暖费由甲方承担。

      During the term of the tenancy, theproperty management fees and the heat-preservation fees shall be paid by PartyA.

7.2   房屋的冷、热水、电、天然气消耗按每月查表实数由乙方支付。

     The cold, hot water, electricity, and gaspayment(for water and tear) of the property shall be paid by Party B accordingto its actual payment per month.

八、   出租人的责任

Landlord’sobligations:

8.1  甲方须按时将出租房屋及其设施以良好的状态交付乙方使用。

  Party A shall deliver the leased property andthe related facilities in good condition to Party B on schedule.

8.2   租赁期内甲方不得收回出出租房屋（除非本合同另有规定）

  Party A shall not take back the leasedproperty durning the term of the tenancy.(Unless otherwise stipulated in thisagreement)

8.4  甲方谨在此声明及保证甲方为出租房屋的合法拥有人并由合法地位出租此房屋与乙方。

     Party A hereby represents and warrantsthat Party A is the legal owner of the leased property and has the necessarylegal capacity to lease the property to Party B.

九、   承租人的责任：

Tenant’sObligations:

9.1  乙方应按合同的规定，按时支付租金，保证金及其他各项应付费用。

     Party B shall be responsible to pay allrents and fees in at timely manner according to the terms of the contract.

9.2  乙方经甲方事先同意，可在承担租用房内进行装修及添置设备，租赁期满必须恢复原状，并承担其费用，经甲方验收认可后归还甲方。

     Party B with the prior consent of Party A,can renovate and install additional facilities in the leased property. Uponexpiration if the tenancy the leased property shall be resumed to Party A inits original conditions and all expenses arising there from shall be borne byParty B.

9.3  乙方应爱护使用租赁的房屋，如因乙方的过失或过错致使房屋及设施受到损失乙方应负赔偿责任。

     Party B shall treat the leased propertywith care. Because of Party B’s negligence or misconduct, the leased propertyand the related facilities suffer any damage. Party B shall be responsible forcompensating Party A for such damages.

9.4  乙方应按本合同的规定合法使用租赁房屋，不得擅自改变其性质，不应存放澳大利亚法律下所禁止的危险物品，如因此发生损害，乙方应承担全部责任。

     Party B shall use the leased propertylegally as agreed in this agreement and may not change such use on its own. PartyB shall not store any dangerous items, which are prohibited by the laws in the Australiain the leased property and shall be fully responsible for any damages or aresult thereof.

9.5  租赁期即将结束之日，经乙方同意，甲方可以带其他客户看房。

     Upon expiration of the tenancy or soonerdetermination of this agreement, Party A could take others to check theapartment with the Party B agreement.

9.6  中英文条款及意思如有不一致之处，双方协调解决。

     In the event that there is the conflictbetween the Chinese version and English version, in such case Party A and PartyB shall go together and resolve the problem.

十、   违约处理：

Breachof Agreement

10.1 乙方如有下列行为之一的，甲方有权终止本合同，收回出租房屋，并且扣除房屋保证金。

     Party A shall have the right to terminatethis agreement repossess the leased property and forfeit the money of thesecurity deposit if Party B commits one of the followings.

a、       未得甲方同意将承租房屋擅自拆改结构改变用途

Altersthe structure of the leased property without authorization or uses the leasedproperty other than for the purpose stated herein.

b、       无故拖欠租金超过3天

Fail topay rent without any reasons more than 3 days after the due date.

c、       中途退租

Toterminate the agreement during the term of tenancy.

十一、适用法律

       Applicable law:

本合同的成立，其有效性、解释、签署和解决与其有关的一切纠纷均受中国法律的管辖并依据澳洲法律并以中文为准。

The formationof this agreement. its validity interpretation exception and settlement of anydisputes arising hereunder shall be governed and according to the laws of theAustralia.
