澳洲500万澳元投资移民引起许多中国成功企业家，各行各业成功人士非常踊跃。但是，自2015年7月之后，该类别的签证申请人数未见有明显的增长。七一之后的移民新政，到底给希望来澳洲发展的成功人士带来了什么样的机会？

9月25日周五，由澳大利亚移民和边境保卫部驻香港领事馆的商业签证审批团队举办的第7次500万投资移民签证申请信息交流会。这次的会议由移民领事Erica Biddle，SIV审批团队负责人MonicaSiu和副经理Wilson Yuen主持。以下是部分会议信息。

500万投资移民申请的最新审批数据

The latest stats from DIBP in Canberra were as follows (as at 30th June 2015)

截至2015年6月30日，堪培拉移民局所公布的最新审批数据为：

• 3249 EOI’s

意向书申请3249份

• 2957 Invitationsissued

签证申请邀请函2957份

• 2573 Primary applications made (93.4% from China)

正式签证申请2573份 (93.4%来自中国)

• 885 primaryvisas issued (91.5% from China)

885份签证获批 (91.5%来自中国)

• Over A$4.425b ofcomplying investment made into Australia

超过44.25亿澳元的相符投资资金已投入澳大利亚

截至2015年8月31日，香港领事馆审批团队所公布的的审批数据为：

• 2430 caseslodged which is over 94% of the total case load (6% are done in Adelaide)

正式签证申请2430份占总申请的94% (6%由阿德莱德移民部审理)

• 1408 casesfinalised (58%) – this includes grants, withdrawals and rejections

Recent Changes

最新变更

• Provisionalvisa 188C period validity has changed from 4 years to 4 years 3 months. This isto allow applicants to fulfil the requirement of holding visa for 4 yearsimmediately prior to applying for PR (888). The applicant can apply for PR from3 years 11 months.

188C 临时签证由4年期限自动延长至4年3个月。这将给予申请人在申请888永居时可以满足4年持有188C签证的要求。申请人可以在持有188C签证3年11个月后开始递交888永居申请。

• Forapplications made on or after July 2015, the term “complying investment” willbe replaced by “complying significant investment” by the HK Processing team tohelp them distinguish between old and new rule investments.

从2015年7月开始，合规投资（complyinginvestment）的官方名称被改为“重大合规投资（complyingsignificant investment）”。目的在于更好的分辨新政合规投资和旧政合规投资。

• After4 years at the 888 visa stage, the DIBP will look back to ensure that thecomplying investment was compliant for the whole period continuously.

4年之后申请人在递交888永居申请时，移民局会审核申请人所进行的投资是否在整个4年期间都保持合规。

Visa Processing Times

审批时间

TheDIBP is processing the applications lodged on prior to 1st July (Old Rules) and after 1st July(New Rules) concurrently. There is a dedicated team for new rule investors andthese visas are getting processed quicker in as little as 28 days in somecases.

移民局正在审理7月1日前递交的申请，并同时审理7月1日后新政申请。移民局安排了另一支团队负责新政的申请，所以新政申请可以在短短28内获得签证官的回复和获批。

The overallaverage processing times are as follows目前的审理时间平均为：

• Time from initial application to invitation letter is 6.3

  months.

从递交申请到获得投资邀请函的平均时间为6.3个月

• Time from initial application to final visa is 8.9months.

从递交申请到获得签证的平均时间为8.9个月

• TheDIBP is currently experiencing some delays in processing applications due tothe large volume (>900) in the weeks immediately prior to the cut-off.

今年4月188C签证暂停前所递交的申情超过900份，因此整个审批速度将有所延迟

• Theteam is currently assessing applications lodged in May 2015. The team will turnto June applications sometime in Nov 2015.

目前审理团队正处理5月份递交的申请，估计11月才能开始审理6月份递交的申请。

• Inorder to improve and expedite the assessment times only 28 days will be givento submit additional supporting documents if requested. Unless a goodexplanation is given for the extension, the application may be refused withoutfurther communication. If an extension is granted it will only be for 7 days ata time.

为了提高和加快审理时间，申请人会有28天的时间补交文件。除非理由充分否则申请将可能因此被拒而不会再通知申请人。每次申请最多可获7天的延期。

• If insufficient documentation is provided within this extension period, the applicant will not be offered another opportunity to address the issue again.

若延期后还是无法递交补充文件，签证官不会再给机会探讨同个问题，申请可能因此被拒。

• If more time is needed to liquidate a client’s SOF assets, transfer funds, obtainclearance for KYC from a fund manager then an extension of time will be givenprovided the hold-up could be explained to them. It is expected that thecomplying investment will be made in no later than maximum of 70 days.

如果需要更多时间兑现资产，转款到境外或基金管理人需要时间完成反洗黑钱和了解客户的尽职调查，一般理由充分的话移民局会给予延期，但投资必须在最长70天内完成。

• Theywarned agents not to assume that clients can take the maximum time of 70 daysas extensions may not be granted without a valid reason. The agent must requestan extension and they have not done so on the expiry of 28 days, a refusaldecision may be made.

移民局再次提醒代理70天的延期不是自动的，必须要有充分理由才会被允许。代理必须书面要求延期，如果在28天内没有向签证官申请延期，申请会因此被拒。

Bogus documents aretreated most seriously and will automatically result in a refusal under thePublic Interest Criterion 4020 which is the ‘integrity’ PIC. It will cause a minimum3-year ban on any Australian visa.

提供虚假文件是非常严重的刑事罪，在PIC 4020“正直品行”条例下自动导致申请被拒，并且在3年内不可申请澳大利亚任何签证。

Source of Funds (SOF)

• The SOFdeclaration should be as detailed as possible, including the applicantsbackground and business profile and where he made his funds for complyinginvestment.

申请人应该提供一份非常详细的资金来源声明包括解释申请人的背景，经商经历和如何累积用来投资的500万资金。

• If an applicant discloses more than A$5m net assets ？

若申请人提供超过500万澳元的净资产？

• Cash/TermDeposits现金/定存: - For fixed termdeposits, is a statement with a maturity date sufficient to prove that themoney is still in the deposit?

若使用定存作为资金来源怎么处理？只提供结月单注明定存的到期日可以证明账户中还有资金吗？

• For financial investments, is a subscription certificate is not sufficient?

若使用理财金融产品作为资金来源，认购协议作为证明文件?

• Where a cash deposit is used for SOF, the caseofficer would generally want more evidence to explain where the fundsoriginally came from.

若使用现金存款作为资金来源，签证官一般会要求申请人证明资金是从哪里获得的。

• Real Estate房产：

- The DIBP needs a property valuation issued byreputable Valuer. The Valuer’s qualification requirements are set-out in thedocument guide.

移民局要求房产估价单需由具有一定资质的公司提供。对于估价公司的资历在支持文件指南里已有注明。

Is the property contract of sale not enough?

申请人仅提供房产购买合同够吗？

• Where a property is used as security for a loan, apre-approved bank valuation is sufficient，is there a need for a thirdparty property valuation?

若申请人用房产质押贷款的话，提供银行出具的预批复贷款文件就能够证明房产的价值，是否还需提供第3方估价单？

• Loans to/from abusiness 贷款给公司或向公司贷款？

若申请人使用以往贷款给公司的资金作为资金来源，必须提供财务报表以证明此笔贷款的时间并提供银行流水单和存款单证明资金转移。

• A loan directly from a business is not allowed asit is not considered the personal assets of the applicant instead it is aliability due back to the business and therefore the funds are encumbered andso ineligible.

直接向公司贷款是不允许的，因为贷款不被视为申请人的个人资产。贷款属于负债的，是必须归还给公司的，因此不符合资金无负债的规定。

Any cash withdrawn from a business？

任何从公司里面提取的资金？

• Companyownership公司股权？

若使用公司股份质押贷款，必须提供审计报告以证明公司的股份价值。审计公司的资质需有国际审计资格（资格要求请参考支持文件指南）。

- Share Trading股票投资？

• Many agents submit pages of documents andstatements which are not clear and confusing so it is impossible for the caseofficer to determine where the profits may have been made. A summary should beproviding highlighting exactly which documents it refers to.

很多代理递交一大叠未整理的投资文件和月结单将使签证官无法清楚知道申请人的收益具体来自哪里，代理应提供一份总结声明

- For securities investment, 对于证券投资？

• Gifts - The CIInvitation letter will not be issued until the gifting arrangement has beencompleted and cash is held under the applicant’s name.

赠予 –在赠予还未转到申请人名下前签证官不会发投资邀请函

对于资金已经在澳大利亚境内，申请人必须提供完整的证明文件追溯资金在转入澳洲前的来源。包括所有的资金转移凭证必须显示是同一笔资金转入澳大利亚的。

• For fundstransfer to Australia, the company who receives money outside China must be thesame company into which the money was deposited in China. The fewer the partiesinvolved in the funds transfer process the better as every party involved willneed to prove their legality. A business license of each company will berequired.

在转款到澳洲时需注意，在国内接收转款的公司和澳大利亚打款到申请人账户的公司必须是同一间。转款过程中，经手人越少越好，因为每一个经手人都必须提供他们的公司注册执照和证明营业的合规性。

申请人可以在获得投资邀请函前完成投资，但是7月1日前做的投资不能用于新政申请。

• If the declaringfund manager does not hold an official position with the responsibility entityof the managed fund, a letter issued by the responsible entity authorising thesigning of the Form on its behalf will be required. ‘Fund of Fund’ managersneeds to submit this.

若基金管理人不是负责管理基金的法人，那么正在负责管理基金的公司必须提供一份声明注明允许授权代签。投资“基金的基金”必须提供这份文件。

• For funds heldin a cash management trust for VCPE purposes (with investment to follow later),an account statement confirming the funds have deposited and a declarationsigned by applicant confirming that the funds will be used for investing inVCPE funds.

承诺投资在风投基金的资金可以暂存在信托账户，但需提交信托账户月结单证明资金已经在账户里，并提供声明注明这笔资金将用投资风投基金。

• There will bestrict monitoring of fund managers during the investment term and DIBP arecurrently working with Austrade to decide on how this will work in practice.

移民局和澳大利亚贸易委员会将携手严格监控基金管理人在进行投资时保持合规。

• Erica Biddlewill finish her HK placement in December and be replaced by Zoe Williams fromCanberra.
