E-2签证是给予和美国有投资条约的国家之公民来美国进行非永久性的投资活动。E-2 签证申请人的国家和美国必须有有效的双边投资条约。如果是法人来美投资,法人有超过的50%的股权必须被条约国公民掌握。 除此之外,申请人还要注意以下四点:
1。 投资的必须是积极(active)的:一个投资项目是否积极的,取决投入资金的 运用情况。如果申请人只有资金财力的证明但是还没有把资金投入项目,这不是积极的投资。因此,在准备E-2 申请时,必须是公司已经成立,办公室已经租好,基本办公设备已经完善,刚成立的公司虽然不需要有员工,但是如果已经雇有员工并开始营运更佳。 ***消极的投资像是买房子、土地、股票等都不能用来申请E-2 签证。
2。投资必须是“可观”(substantial)的投资:在衡量金额是否可观时,移民局和国务院没有订立投资的最低金额,你的投资是否“可观”没有一个绝对的标准。通常政府要看你的投资金额在此种商业领域是否合适。举个例子来说,如果是一个波霸奶茶店可能十万八万美金就足够,如果你投资的是一个汽车旅馆的话,三、五十万美金都算是少的。因此,你投资的行业的类别影响了你要投入金额的多寡。
3。 投资最好能够创造就业机会: 虽然移民法没有明确的要求E-2 申请人的投资必须创造就业机会,但是移民法同时又要求E-2投资不能是“边缘化的”(marginal)。移民官解读“边缘化”涵意时包括投资要创造申请人以外的就业机会。因此,在申请E-2 时,还要有详细的商业计划,来证明公司将来有能力创造就业机会。
4。申请人在投资项目里扮演重要角色:在申请E-2 时,申请人必须证明他将在投资项目里扮演重要的角色。角色是否重要,取决与申请人是否有决定公司政策和发展的权力。一般主管级的职位都是重要的角色。如果这是一个新成立的公司,还没有员工是可以理解的,如果这家公司成立了几年的话,至少要有几个员工来证明的主管能力。
台湾、澳大利亚、加拿大、新加坡、泰国等都与美国有投资条约,所以可以提出E-2 的申请。中国大陆和美国没有条约,所以中国大陆的公民没有资格申请E签证。但是,如果配偶一方属于与美国有投资条约的国家之公民,可以透过有资格的一方提出E-2 申请。例如你的太太是加拿大公民,而你持中国大陆护照,可以透过以你太太的名义提出E-2 申请,而你也同时可以以家属身份申请E-2 签证并申请工卡在美国工作。
此外,如果你符合上述条约国投资人的要求,不论你在美国持有F-1 学生或F-2 配偶,刚来美国商务考查,目前是H-1B/H-4,甚至是L-1 跨公司主管但是公司营运不如预期延期L-1 有困难的情况下,都可能可以考虑改申请E-2 签证在美停留工作。
