We see it quite often that clients purchased a property, but experience issues in obtaining finance, or just simply want to add someone else onto the title before the property settles.

 我们经常遇到买房的客户在申请贷款时不顺利,或者客户只是单纯想添加另一个人的名字在地契上。


Good news is, you can do this!

没问题!这是可以做到的!


You can add a person that is of ‘direct relation’ to you onto the title before the property is officially transferred, which we refer to as ‘property settlement’. You only need to pay stamp duty once when you decide to do one of the following before property settlement:

您可以在购买的房产正式过户,就是我们常说的“房屋交割”前,选择加上您“直系亲属”的名字。

1 Remove yourself from the transaction and give the property to someone that is of direct relation to you, for example, your father, mother, or sibling (there is more on the list).

移除自己的名字,再把房产转给您的直系亲属,比如您的父母或者兄弟姐妹(名单上还有其他亲属)。

Add one or more people of direct relation to the property transaction.

添加一个或者更多的直系亲属名字。

This is permitted under the Duties Act so you don’t have to pay double the stamp duty.

法律上是允许这样操作的,这样您就无需双重的印花税了。

What happens when you have a property that is only under your name and you want to add on your spouse?

如果房产只属于您一个人,而您想添加配偶的名字该怎么办?

 

You can do this and not pay stamp duty again if it is your ‘principal place of residence’.  It does not matter whether you bought this property before you got married or entered into a de facto relation or afterwards. 


这是可以做到的,而且如果这是你们的“主要住所”,则无需额外支付印花税。这套房产可以是您在婚前购买的,也可以是您在婚后或者达到事实婚姻条件之后购买的。 

This is permitted under the Duties Act and the recognised relationships are:

But if you have a mortgage on the property, you need to make sure your lender will consent to this first!
